Miscellaneous
General Terms and Conditions of Travel
1. Introductory provisions
1.1 What is a package holiday?
1.1.1. ”Package holiday” means an arrangement which has been organised prior to the conclusion of the contract and which consists of:
• transport and
•accommodation or
•any of these services in combination with any tourist service which forms a significant part of the package and which is not directly linked to transport or accommodation.
1.1.2. In addition, it is a condition that the package lasts for more than 24 hours or includes overnight accommodation, and is sold or marketed for a single price or for separate prices that are linked to one another.
1.2 General obligations of the passenger
1.2.1. The traveller is responsible for ensuring that he or she holds a complete and valid passport and any other documents necessary for the journey and, where required, a visa and the necessary vaccinations.
1.2.2. The passenger must have completed check-in for all flights included in the package holiday in accordance with the itinerary or other instructions.
1.2.3. The traveller must comply with the rules and regulations laid down by the organiser or applicable to the services included in the package holiday, such as hotels, airports, means of transport, etc.
1.2.4. The traveller must always behave in such a way that fellow travellers are not inconvenienced. Serious breaches may result in the traveller being excluded from further participation in the trip by the organiser or the organiser’s representative. In such cases, the traveller must arrange their own return transport and bear any costs incurred in connection with this.
1.2.5. Upon entering into the contract, the traveller shall inform the organiser of their nationality, including details of whether they hold a Swedish or foreign passport and of any dual citizenship, so that the organiser can fulfil its obligation to provide information on any passport and visa requirements. The organiser’s obligation to provide information on passport and visa requirements applies only in relation to EEA nationals.
1.2.6. The traveller must, immediately upon receipt, carefully check the confirmation, tickets and other travel documents to ensure that the details correspond to what was agreed and that names are spelled in the same way as in the passport. Any errors must be reported to the organiser immediately.
1.2.7. The traveller must immediately notify the organiser of any changes to their address, email address, telephone number or other details that are relevant to the organiser’s ability to contact the traveller.
1.2.8 The traveller must comply with any rules specified by the organiser regarding flight reconfirmation, which apply to individual trips and package tours without a tour leader. Failure to reconfirm will result in the relevant airlines being entitled to reallocate the reserved seats, and the traveller may therefore lose the right to use the remaining flights.
1.2.9. Passengers must keep themselves regularly updated on departure points and times, e.g. by checking information screens immediately upon arrival at an airport and contacting airport staff if in any doubt as to which terminal or exit the flight is departing from. This information is subject to frequent changes, which are beyond the organiser’s control.
1.2.10. If the traveller has not complied with the above obligations, he or she may not make a claim against the organiser, the agent or any subcontractor to the package tour for the consequences arising from the traveller’s failure to comply with these obligations.
1.3. Price and agreed services
1.3.1. Information contained in leaflets and brochures, including on the Internet, forms part of the contract. This information is binding on the organiser, unless the organiser has expressly reserved the right to make changes in the catalogue or brochure and the traveller has been informed of such changes before the contract is concluded.
1.3.2. The traveller must pay the price of the trip no later than the date specified in the contract. The organiser is entitled to charge an initial instalment upon conclusion of the contract (booking fee). If the full price of the trip is not paid upon conclusion of the contract, the remaining amount must be paid by the date specified by the organiser.
1.3.3. The price must be stated in such a way that the total cost of the trip is clearly indicated. It must include all services covered by the contract, as well as any compulsory surcharges, taxes and fees.
1.3.4. At the destination, there may be airport charges, admission fees and other local charges which cannot be charged at the time the contract is concluded, as these depend on local regulations or on the use of additional services not included in the contract.
1.3.5. Unless otherwise expressly stated, the price of the trip is based on accommodation in a shared double room. If accommodation for one person only is requested, the organiser is entitled to charge a single room supplement, regardless of whether this occurs after the contract has been concluded or as a result of a subsequent unforeseen event, such as a fellow traveller falling ill. Any single room supplement will be invoiced to the traveller immediately after the organiser has been informed of, or has otherwise ascertained, the change.
1.3.6. A connecting journey or a special package is included in the contract only if these have been sold or marketed together with the main package for a single price or for separate prices that are linked to one another.
1.3.7. Any special services or arrangements requested by the traveller are included in the contract only if they have been expressly confirmed by the organiser.
1.3.8. If, in the case of a package holiday, a minimum number of participants is required for the trip to go ahead, the organiser’s marketing material must state the number of participants required for the trip to go ahead, as well as the latest date by which the traveller must be informed that the trip will not take place. If the minimum number of participants required for the trip to take place is not reached, the organiser is entitled to cancel the trip. In such cases, the traveller is not entitled to compensation.
1.3.9. Before the contract is concluded, the organiser shall inform the traveller of any passport and visa requirements, as well as any health regulations that may apply during the journey.
1.3.10. The organiser’s obligation to provide information regarding passport and visa requirements applies only to nationals of states within the European Economic Area (EEA). If the traveller is not a national of such a country, they are responsible for finding out for themselves what applies with regard to passports and visas.
1.3.11. Before the contract is concluded, the organiser must provide the traveller with information regarding the option of taking out travel insurance and/or any cancellation insurance/cover. Cancellation insurance/cover cannot be added at a later date. If the organiser offers cancellation insurance/cover and the traveller wishes to take out such cover via the organiser, the traveller must inform the organiser of this no later than when the contract for the purchase of the package holiday is concluded.
1.4. Conclusion of the contract
1.4.1. The contract becomes binding on the parties once the organiser has confirmed the traveller’s booking in writing. The organiser shall confirm the traveller’s booking without delay.
1.4.2. However, the organiser may instead stipulate that the contract becomes binding on the parties once the organiser has confirmed the traveller’s booking in writing and the traveller has paid the booking fee within the agreed time or, if no booking fee is payable, the full price of the trip in accordance with the organiser’s instructions. Such a provision must be clearly stated in the organiser’s terms and conditions.
1.4.3. If the traveller fails to make payment in accordance with the contract, the organiser is entitled to terminate the contract. In the event of such termination, the organiser is entitled to payment of the amount that the traveller would have paid had the traveller cancelled the trip in accordance with the cancellation rules set out in section 3.
2. Amendment to the agreement
2.1. Price changes
2.1.1. If the organiser incurs cost increases after the contract referred to in clause 1.4 above has become binding on the parties, the organiser may increase the price of the trip by an amount corresponding to the cost increases, provided that these are due to:
•changes in transport costs, including fuel prices
• changes to taxes, customs duties and charges, or fees for certain services, such as airport, port, landing and take-off charges
• changes in exchange rates, which are used when calculating the price of the package holiday.
2.1.2. In such cases, the price may be increased by an amount corresponding to the traveller’s share of the increase in costs incurred by the organiser in fulfilling the contract. If, for example, a charge under clause 2.1.1. above increases by 100 kronor per traveller, the price may be increased by the same amount.
2.1.3. The right to a price increase as set out above applies only if the increase in costs exceeds 100 kr.
2.1.4. The price must not be increased during the last 20 days prior to the agreed date of departure. The organiser must inform the traveller of any price changes as soon as possible.
2.1.5. The price of the trip shall be reduced accordingly if the organiser’s costs decrease more than 20 days before the agreed date of departure, for the same reasons as stated above. In the event of a reduction in costs, the price shall be reduced only if the reduction in costs exceeds SEK 100.
2.2. Transfer of a package holiday
2.2.1. The traveller is entitled to transfer the trip to another person. However, this is subject to the condition that the person to whom the package holiday is transferred meets the necessary conditions and requirements for participation in the package holiday, as specified by the organiser at the time the contract was concluded. The right to transfer the trip may be restricted, in whole or in part, by the organiser if a transfer is not possible due to conditions imposed by a subcontractor. If, for example, an airline ticket may not be transferred under the airline’s terms and conditions, a transfer of the package holiday means that the traveller will not receive a refund for the airline ticket and that the person to whom the holiday is transferred must purchase a new airline ticket. Any restrictions on the right to transfer a trip must always be clearly stated in the contract.
2.2.2. The traveller and the person to whom the package holiday is transferred are jointly and severally liable for the outstanding amount due for the trip and for all additional costs arising from the transfer. In addition, the organiser is entitled to reasonable compensation for the extra work incurred as a result of the transfer.
2.3. Amendments following the conclusion of the contract
2.3.1. Passenger requests for changes prior to departure
2.3.1.1. In the event of changes made after the conclusion of the contract to the travel dates, destination, hotel, travellers, etc., the organiser is entitled to charge an administrative fee in addition to reimbursement of the actual costs incurred as a result of the change.
2.3.1.2. Once the contract has become binding, it is often not possible to make changes to the agreed services. This may apply, for example, to cruises, airline tickets and hotel rooms, and must be stated in the contract. In the event of changes, the traveller is therefore not entitled to a refund of that part of the package holiday price which represents the cost of these services.
2.3.2. Changes or cancellations by the organiser prior to departure
2.3.2.1. If the organiser is obliged to cancel the trip or if it cannot be carried out as agreed, the traveller must be informed of this as soon as possible.
2.3.2.2. However, this does not apply to changes or deviations which may be considered of minor importance to the passenger.
2.3.2.3. If the change results in the financial value of the journey being reduced, the passenger is entitled to a reduction in the price.
2.3.2.4. If the changes made to the contract by the organiser are substantial, or if the trip is cancelled through no fault of the traveller, he or she may:
•terminate the contract and be refunded the full amount he or she has paid under the contract, or
• take part in another package holiday, if the organiser is able to offer this.
2.3.2.5. The traveller shall, within a reasonable time of receiving notification of a change or cancellation of the trip, inform the organiser of their choice.
2.3.2.6. If the replacement holiday is of a lower value than the original package holiday, the organiser must refund the difference in price to the traveller.
2.3.3 Changes made by the organiser after departure
2.3.3.1. Due to circumstances arising after departure, the organiser may be unable to provide parts of the agreed services. In such cases, the organiser shall offer alternative arrangements.
2.3.3.2. For certain package holidays, it may be difficult to predict the exact course of events due to their specific nature. Changes in weather conditions, road diversions, political events, etc. may mean that the organiser is forced to make changes to the itinerary. In such cases, the organiser shall, where possible, offer the traveller alternative arrangements. If the change results in a deterioration of the traveller’s experience, they may be entitled to compensation and/or a price reduction.
2.3.3.3. Whether changes to the agreed services under 2.3.3.1 or 2.3.3.2 are due to circumstances beyond the organiser’s control, which the organiser could not reasonably have been expected to have foreseen when the contract was concluded and the consequences of which the organiser could not reasonably have avoided or overcome, the traveller shall not be entitled to compensation. If changes are due to a subcontractor engaged by the organiser, the organiser is exempt from liability for damages only if this is due to a circumstance beyond the subcontractor’s control.
3. Termination of the agreement
3.1. Cancellation of a package holiday by the traveller – general provisions
3.1.1. The passenger must cancel the trip in the manner specified in the contract. Unless otherwise stated, the cancellation must be made in writing.
3.1.2. The cancellation fee is always at least 300 Swedish kronor per passenger.
3.1.3. In many cases, the terms and conditions governing the services included in the package holiday – such as flight and event tickets, hotel accommodation, etc. – mean that these cannot be cancelled. In such cases, provided that the organiser has informed the traveller of these terms and conditions before the contract is concluded, the traveller must pay the full cost of the service(s) concerned. For other services included in the package holiday, and where the organiser has not informed the traveller in accordance with the preceding paragraph, the provisions of 3.1.4 – 3.1.7 shall apply
3.1.4 If the booking is cancelled more than 30 days before departure, the traveller must pay 10 % of the price of the trip.
3.1.5 In the event of cancellation between 30 and 15 days before departure, the traveller shall pay 25 % of the price of the trip.
3.1.6 In the event of cancellation between 14 days and 72 hours before departure, the traveller shall pay 50 % of the price of the journey.
3.1.7 If the booking is cancelled less than 72 hours before departure, the traveller must pay the full price of the trip.
3.2. The organiser’s right to withdraw from the contract on the grounds of force majeure.
3.2.1 In accordance with the Contracts Act, ea breach of contract is excusable (force majeure) if performance under the contract has been prevented by circumstances beyond the control of a party, which that party could not reasonably have been expected to have foreseen or taken into account at the time the contract was concluded, and the consequences of which that party could not reasonably have avoided or overcome. The organiser is entitled to terminate the contract if, after the contract has become binding on the parties, a natural disaster, acts of war, a general strike or any other significant event that substantially affects the conduct of the trip or the conditions at the destination at the time the trip is due to take place. If the organiser terminates the contract pursuant to this provision, the traveller is not entitled to compensation.
3.2.2. The assessment of whether an incident is to be regarded as one of those specified in 3.2.1. shall be made taking into account official statements from Swedish and international authorities. A travel advisory issued by the Ministry for Foreign Affairs advising against travel to the destination in question shall be regarded as such an event.
3.2.3. The passenger is not entitled to cancel the booking under clause 3.2.1 if, at the time the contract was concluded, he or she was aware that such a force majeure event, as referred to in this clause, existed, or if the event was common knowledge.
3.2.4. If the traveller is not entitled to cancel the trip under clause 3.2.1 but cancels it nevertheless, the organiser’s general cancellation rules set out in clause 3.1 shall apply.
3.2.5. In the case of round-trip packages, the traveller is only entitled to cancel that part of the package tour which is affected by the intervening event. However, if this part of the package tour constitutes a significant part of the package tour, the traveller is entitled to cancel the entire trip.
3.3. Cancellation cover and cancellation insurance
3.3.1. If the traveller has taken out cancellation cover or cancellation insurance, the trip may be cancelled in accordance with the specific terms and conditions applicable to the cancellation cover or cancellation insurance.
4. Errors and omissions
4.1. Complaints
4.1.1. In the event of a fault in the agreed services, the traveller must, as soon as he or she has noticed or ought to have noticed the fault, lodge a complaint with the tour operator, its representative or the subcontractor concerned, in order to give them the opportunity to rectify the fault. Where possible, the complaint should be made at the destination.
4.1.2. Where possible, the traveller should ensure that the complaint is documented in writing by the organiser or their subcontractor on site.
4.1.3. The passenger may not claim that there has been a fault unless a complaint has been made in accordance with the provisions set out above.
4.1.4. Claims for compensation or a price reduction must be made to the tour operator as soon as possible after the end of the trip.
4.1.5. If a claim is made on the grounds of a fault in the agreed services more than two months after the date on which the passenger noticed, or ought to have noticed, the fault, the passenger shall be deemed to have forfeited the right to rely on that fault.
4.2. Rectification of faults
4.2.1. If the organiser offers to remedy the fault, the traveller may not claim a price reduction or cancel the contract, provided that the fault is remedied within a reasonable time and at no extra cost or significant inconvenience to the traveller.
4.2.2. The passenger must always minimise damage as far as possible.
5. Limitations on the organiser’s liability for compensation
5.1. The organiser’s liability for claims arising from damage or fault is limited to the limits applicable at any given time, as set out in the Warsaw and Montreal Conventions (for air travel) and the Athens Convention (for transport by sea and inland waterways). The organiser’s liability cannot therefore exceed that applicable to the subcontractor(s) who bear direct responsibility for the defective service.
5.2. Airlines are directly liable for the proper performance of carriage in accordance with the Warsaw and Montreal Conventions, EU Regulation 889/2002, EU Regulation 261/2004 and the Civil Aviation Act.
5.3. The above means that, in the event of delayed, lost or damaged luggage, the passenger must, in the first instance, make a complaint to and direct their claims against the contracting or operating airline. Claims must be made as soon as the passenger becomes aware of the circumstances.
Claims for loss or damage should, where possible, be made at the airport of arrival, at which point a damage report (known as a PIR report) should be drawn up.
5.4. The organiser accepts no liability for medication or any valuables, such as cameras, cash, jewellery, etc., which have been placed in checked-in luggage. Some airlines offer special insurance cover for items that are prone to theft. In such cases, a specific declaration must be made directly to the airline at check-in.
5.5. It should be noted in particular that airlines often have mutual agreements on how they handle each other’s flights. To make it easier for passengers to lodge complaints and appeals, the Montreal Convention stipulates that they always have the right to choose whether to make a claim against the airline named on the travel documents (the contracting carrier) or the airline that actually carries out the transport (the operating carrier).
6. Disputes
6.1. The parties should endeavour to resolve any dispute concerning the interpretation or application of the agreement through negotiation. If the parties are unable to reach an agreement, the dispute may be referred to the National Board for Consumer Complaints or to a court of law.
Special travel conditions
Special terms and conditions for package holidays sold to business customers. These terms and conditions also apply to private individuals in respect of each respective part of the package holidays.
1. Scope
These special terms and conditions shall apply to the sale of package holidays to business customers. The provisions of the Package Holidays Act (1992:1672) shall not apply to this contract.
2. Definitions
Unless otherwise specified, the following terms shall have the meanings set out below in this agreement.
Organiser: DSI Sweden AB
Customer: The person responsible for paying for the package holiday
Package holiday: A package comprising two or more travel services, such as transport, accommodation and a conference
Traveller: The individual person or persons taking part in a package holiday
3. The Agreement
The contract becomes binding when the Customer accepts the Organiser’s quotation. The Organiser shall confirm the Customer’s booking in writing by post, email or text message without delay.
These special terms and conditions, together with the Organiser’s confirmation, constitute the full terms and conditions of the Package Tour. In addition, however, the special terms and conditions set by the Organiser’s subcontractors (e.g. airlines) in respect of a particular service or product may also apply.
4. Price and changes to the price
The total price of the package holiday is stated in the confirmation. Unless otherwise stated in the confirmation, payment for the package holiday shall be made in accordance with this clause.
The price is based on the conditions applicable at the time of confirmation. The organiser reserves the right to increase the price in the event of changes in exchange rates, new or increased charges, taxes or surcharges (such as fuel surcharges) arising after that date.
50 % of the total price for the package holiday is invoiced when the Customer accepts the Organiser’s quotation (booking fee). The remaining portion of the price must be paid no later than 35 days before departure. The booking fee is non-refundable in the event of cancellation.
For each change to an order that has already been placed, the Organiser is entitled to charge the Customer 500 Swedish kronor per person per change.
Any additional costs arising from orders placed by the Customer after the Organiser’s confirmation will be charged separately at the actual cost, plus a fee of 500 kronor.
5. Amendments to the agreement
The organiser shall, where possible, accommodate the Customer’s requests for any amendments to the contract.
The organiser reserves the right, in addition to the fee specified in the previous paragraph, to charge the Customer for any fees charged by subcontractors in connection with the amendment.
6. Cancellation of the trip
Cancellation of a booked package holiday must be made in writing by post or email. If the Customer cancels, the following charges will apply.
•If cancelled more than 60 days before departure: 50 % of the price of the trip
•For cancellations made between 59 and 15 days before departure: 90 % of the trip price
•If you cancel 14 days before departure or later, 100 % of the price of the trip
In the event of cancellation of parts of a package tour or of an individual traveller, the cancellation fee shall be calculated on the basis of the portion of the price attributable to the relevant part or traveller. In addition to the cancellation fee stated above, further costs may be incurred by the Customer due to the specific terms and conditions of subcontractors. In the event of cancellation of non-refundable flight tickets, the cost will normally amount to the full price. Event tickets are non-refundable.
7. Cancellation cover
If the Customer has taken out cancellation insurance, the insurance company’s terms and conditions for this insurance shall apply.
8. Change of name, etc.
The Organiser shall, where possible, comply with the Customer’s request to change a Traveller once the contract has become binding in accordance with clause 3. A change of Traveller shall be regarded as a cancellation and a new booking, and the relevant charges set out in this contract shall therefore apply.
The customer is responsible for all costs associated with the change. In addition to the Organiser’s fee, further costs may be incurred due to subcontractors’ specific terms and conditions relating to the service(s) concerned.
9. Force Majeure
The Organiser shall not be liable for any errors, delays or other damage resulting from legislation, measures or orders by public authorities, acts of war, strikes, natural disasters or any other similar circumstances or events beyond the Organiser’s control.
If a circumstance as described in the preceding paragraph arises, the Organiser shall be entitled to terminate the contract. In such cases, the Customer shall not be entitled to any compensation or damages. If the Organiser terminates the contract pursuant to this provision, the Customer shall only be entitled to a refund for unused services if, and to the extent that, the Organiser receives a refund from the relevant subcontractors.
10. Disclaimer
The organiser shall not be liable for any loss or damage suffered by the Customer and/or the Traveller arising from the actions of an airline engaged by the organiser to operate a flight forming part of the package holiday, for example due to delays, cancelled flights, etc. In such cases, any claims by the Customer or the Traveller must be directed straight to the airline concerned.
11. Complaints and rectification
A customer or traveller may not invoke any fault or deficiency in a package holiday arrangement unless a complaint has been made in writing to the organiser as soon as possible after the fault or deficiency was discovered or ought to have been discovered, but no later than 14 days after the end of the trip. Where possible, complaints should be made at the destination.
12. The Customer’s and the Traveller’s responsibilities
The Customer and Travellers are responsible for checking all the details in the documentation relating to the Package Tour immediately upon receipt, regardless of the form in which it is received (by email or otherwise). Should any information prove to be incorrect, the Organiser must be notified immediately. The Organiser reserves the right to charge a fee for correcting incorrect information.
The Customer and Travellers are responsible for finding out for themselves what requirements apply regarding passports, visas, vaccinations, certificates, etc. that are necessary for the package holiday.
During the package tour, the Customer and Travellers must follow all reasonable instructions and recommendations from the Organiser and its subcontractors. The Customer and Travellers are liable for any damage they cause to the Organiser through negligence, for example by failing to follow the instructions and regulations provided by the Organiser and its subcontractors.
13. Event tickets
Events may be rescheduled from their original date, time and venue. It is the traveller’s own responsibility to keep themselves informed of any changes to events. Any additional costs incurred by the traveller as a result of an event changing its date, time or venue are the traveller’s own responsibility. Event tickets are non-cancellable and non-refundable, regardless of any other cancellation policies.
At events involving the home or away teams, there may be rules regarding behaviour and dress code. It is the traveller’s own responsibility to familiarise themselves with the relevant rules for each event.
15. DSI Sweden AB reserves the right to correct any printing or typographical errors on its website, in advertising material, booking confirmations, travel information and invoices.
14. Dispute
Any dispute arising from this agreement shall be settled by the Stockholm District Court.
